Should your ex-partner deny mediation, you may go to court to ask for an Interim Court Order. This will lawfully allow you to have access to your children, and should your ex-partner show no opposition to interim contact, it may be resolved without a court case.
Out of Community of Property “Without Accrual” marriage
There is no sharing of debts or liabilities and each of the spouse retains his or her independence. Their assets remain their own separate property and cannot be touched by any creditor. This also applies to any insolvency by one of the spouses.
Sharing of assets depends on how you were married:
In Community of Property marriage
Both parties are liable for the debts and liabilities of the other, regardless of which one of them incurred the debt. Assets are divided equally.
Out of Community of Property “Without Accrual” marriage

Out of Community of Property Marriage With Accrual
A calculation is done to determine how much of assets each of the spouses accrued for the duration of the marriage. They would have to indicate in the ANC, what the initial value of their respective estates was at the commencement of the marriage. The spouse whose estate shows a higher accrual would need to pay half the difference of the net accrual to the estate with the lesser accrual.

URESHNIE GOVENDER
Corporate Lawyer
In 2011, I was such a broken woman with a broken marriage and finally decided to divorce. My estranged husband abandoned me and my two children in 2006 for a mistress. I was referred by a Durban Judge, Rajesh to contact Tash. He noted to me that Tash was a petite, small woman, that did big damage in terms of fighting cases and winning them. Despite numerous calls to Tash’s office, I chickened out and dropped the calls as I could not afford exorbitant lawyer fees. I was also terrified of courts and battles but Tash made sure that her staff contacted me for a consultation and reassured me that costs will be minimum. Both herself and her staff gave me support and taught not to fear. Today, I never regretted choosing Tash as my lawyer, as Rajesh was absolutely correct that dynamite comes in small packages. The case is still proceeding, and Tash has reassured me and my children that justice will be done.
This is the best group of attorneys you will find. They do more than there 100% for their clients. Got a lot of patience and compassion. I have got the greatest admiration for them in the criminal and civil matter. I find Tashya to be the best criminal lawyer I have come across.
Thank you for your professional services. You have provided outstanding legal counsel…I am affiliated with many firms of attorneys, however, must mention that your firm is the most trustworthy and dependable that I have come across. I am very pleased to have you as my legal team. Through our entire business relationship, you have been responsive and detail oriented which has allowed me to stay focused.
It is a real pleasure to visit your practice and ask you to attend to my legal problems. Your staff are very friendly, pleasant and also very accommodating. I find it a privilege to know and deal with you and your staff.
